Debt relief for individuals and self-employed

Second Chance: cancel your debts and start again

The Second Chance Law allows individuals and self-employed workers in a situation of insolvency to cancel all or part of the debts they cannot meet, offering a legal mechanism to rebuild their financial life without giving up their dignity. At Muñoz-Vidal y Rubio we have been helping people like you to get out of a seemingly bottomless hole for years.

Situations where we can help

You have debts you cannot pay due to an unforeseen situation: job loss, business closure, divorce or illness.

You are a self-employed worker or individual of good faith who has tried to pay but the situation has exceeded your capacity.

You want to prevent your debts from following you for the rest of your life and blocking your financial future.

You need protection from creditor harassment and garnishments that prevent you from living peacefully.

Our approach

How we approach each case to achieve the best result.

1

We analyse your financial situation in detail to determine whether you meet the law's requirements and what outcome you can expect.

2

We try to reach an out-of-court agreement with your creditors to avoid insolvency proceedings, when possible and advisable.

3

If no agreement is reached, we process the consecutive insolvency and request the discharge of unsatisfied liabilities.

4

We accompany you at every step, explaining clearly what is happening and what you can expect at each stage.

Indicative process

01

Initial consultation: we assess your case and confirm whether you can benefit from the procedure.

02

Document gathering: we help you collect the necessary documents for the file.

03

Out-of-court agreement or insolvency: we negotiate with creditors and, if appropriate, process the insolvency.

04

Discharge: we request the judge to cancel the debts you could not pay.

Frequently asked questions

Can I keep my primary residence if I use the second chance?
It depends on each case. The law allows, in certain circumstances, keeping the primary residence through a payment plan, but an individual analysis of your situation is necessary.
Which debts can be cancelled?
Most ordinary debts (loans, cards, suppliers) can be cancelled. There are legal exceptions, such as debts with Social Security or the Tax Authority, which follow a specific regime.
How long does the procedure take?
The duration varies depending on the complexity of the case, but typically ranges from 12 to 24 months from start to discharge resolution.
Do I need a lawyer to apply?
Yes. The second chance procedure requires a lawyer and a procurator, and it is mandatory to have an insolvency mediator. We coordinate the entire necessary team.
