Appeals against the Administration and public contracts

Administrative law: defence against the Public Administration

Administrative law regulates the relationship between citizens, businesses and the Public Administration. When the Administration adopts a decision that harms your rights or interests, there are legal mechanisms to challenge it. At Muñoz-Vidal y Rubio we advise individuals and companies in their relations with the Administration, from licence applications to administrative judicial appeals.

Frequently asked questions

How long do I have to appeal an administrative sanction?
The deadline to file an administrative appeal is generally one month from notification. Once the administrative route is exhausted, the deadline to appeal before the administrative court is two months.
Can I claim against the Administration for suffered damages?
Yes. The patrimonial liability of the Administration allows claiming compensation for damages suffered as a consequence of the operation of public services, provided there is no force majeure or exclusive fault of the injured party.
Can the Administration deny a licence without justification?
No. Every administrative decision affecting rights and legitimate interests must be justified. If the denial is not sufficiently reasoned, it is subject to appeal for breach of the principles of administrative action.
